Terms of Service

These Terms of Service ("Terms") govern your use of PlayBook, a free, map-based directory operated by PlayBook Kids LLC ("PlayBook," "we," "us," or "our") that helps parents and guardians discover local children's activities and public places (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use PlayBook.

What PlayBook is

PlayBook is a directory, not a marketplace. We help you find providers (such as swim schools, sports clubs, STEM labs, and dance studios) and public places, and then link you out to each provider's own website or contact details. We are not a party to any relationship, booking, registration, or transaction between you and a provider, and no payments or bookings are made through PlayBook.

Eligibility and accounts

• You must be at least 18 years old to create an account.
• You are responsible for the information you provide and for keeping your login credentials secure. You are responsible for activity that occurs under your account.
• You may sign in with email or with Google. If you use Google sign-in, you also agree to Google's applicable terms.

Provider listings and verification

Provider information is supplied by providers themselves or compiled from public sources (such as a provider's own website or public business listings), and providers are responsible for the accuracy of their listings. PlayBook does not vet, inspect, license-check, or otherwise perform due diligence on providers, and the inclusion of a listing is notan endorsement or recommendation. Where a listing displays a "Verified" badge, it means only that the provider has confirmed the listing's details with us; it is not a certification or guarantee of quality, safety, licensing, or suitability. Always confirm details — including pricing, schedules, qualifications, and safety — directly with the provider before enrolling your child.

Provider terms

If you submit, claim, or confirm a listing as a provider, you represent that you are authorized to act for that business and that the information you provide is accurate and not misleading. You grant PlayBook a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that information for the purpose of operating and promoting the Service. You are responsible for keeping your listing accurate, and you may request correction or removal of your listing by contacting us. We may edit, decline, or remove any listing at our discretion, including where information appears inaccurate, outdated, or in breach of these Terms.

Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Post false, misleading, infringing, or inappropriate content, or impersonate any person or organization.
• Scrape, harvest, or bulk-extract data, or interfere with or disrupt the Service or its security.
• Attempt to gain unauthorized access to any part of the Service.

Our content and intellectual property

The Service, including its design, text, graphics, logos, and the compiled directory of providers and places (the "PlayBook Database"), is owned by PlayBook Kids LLC or its licensors and is protected by intellectual property and database laws. We grant you a limited, personal, non-transferable license to use the Service for your own non-commercial purposes. You may not copy, reproduce, extract, re-use, or create derivative works from the PlayBook Database or any substantial part of the Service without our prior written permission. "PlayBook" and our logos are our trademarks and may not be used without permission.

Third-party links and services

The Service links to third-party websites and uses third-party services (such as maps and email). We do not control and are not responsible for third-party content, products, or practices. Your use of those sites and services is subject to their own terms and policies.

Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or any listing will be accurate, complete, uninterrupted, or error-free. You are solely responsible for evaluating the suitability and safety of any activity or provider for your child.

Limitation of liability

To the fullest extent permitted by law, PlayBook and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service or from your dealings with any provider. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless PlayBook Kids LLC and its members, officers, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content or listing, your dealings with any provider, or your breach of these Terms or of any applicable law.

Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if we are required to by law, or to protect the Service or other users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

Changes to the Service and Terms

We may modify or discontinue the Service, or update these Terms, at any time. When we make material changes to these Terms we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service that is not otherwise resolved will be brought exclusively in the state or federal courts located in Nassau County, New York, and you consent to the personal jurisdiction of those courts.

General

These Terms are the entire agreement between you and PlayBook regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
